Will the government retrospectively apply the right to repair legislation when its enacted in the summer of 2021? Currently, it applies to new equipment, will it be extended to cover the equipment you already have?

Some manufacturers will opt for replacing equipment rather than repair it, asking a customer to dispose of the faulty equipment. It’s disappointing that we live in a world where the cheapest option is to replace something and not repair it!

We are aware of at least two occasions where customers have been asked to dispose of equipment in exchange for a new replacement. This equipment could have been reused or repaired.
- A machine with a RRP £129 had a coffee capsule stuck inside the brew chamber. This equipment was replaced by the seller with the request to dispose of the original piece. This was subsequently repaired and reused.
- A well-known coffee subscription business opted to replace and not repair some broken equipment. That customer contacted Espresso@Home saying it was a shame to dispose of the equipment and offered it to us for spares!

Consumer Right Act
There may well also be some statutory rights you can call upon.
The consumer rights act specifies that products bought from a retailer must be of satisfactory quality, fit for purpose, and as described.
You may be able to draw on these rights if you’ve had the equipment for a while.
The date of your purchase determines which legislation applies.
- If you bought your goods any time from 1 October 2015, then the Consumer Rights Act applies.
- If you bought your goods on or before 30 September 2015, then the Sale of Goods Act will apply.
